Over on Fox News earlier tonight "reporter" John Solomon reads a statement from Trump's office. It says, essentially, that Trump was just taking his work home with him like a lot of us.

Does not matter. Commander in Chief controls the documents and classifies them. No laws were broken.
And available to Commander in chief in which no time limitations are stated.

It's perilous to cite statutes out of context. The Presidential Records Act was enacted to prevent presidential abuses of power relating to records used or produced by a president or his staff. It came about after Nixon tried to claim ownership of some of the records of his presidency.

Nixon lost his claim at the Supreme Court, and Congress passed the PRA to make sure no president ever again could pull that kind of bullshit. Of course, Nixon, being the semi-principled human that he was, accepted the outcome.

Basically, the PRA makes the president custodian of the records used and produced by his office during his tenure. But upon a president's leaving office, custody of those records automatically transfers to the National Archives. The entire time, the ownership of the records is with the public. The PRA makes clear that the records are owned by the public, not the president, even if the public can't have access to them for whatever reasons.

There's a whole other set of rules respecting classified materials. Trump has apparently violated several of those rules as well.

Trump took the records out of the White House in violation of the Presidential Records Act they belong to the National Archives, not the President to do with what he wants... He was asked early on to return them, he didn't... it's all on Trump...

That section of the PRA says that a former president's records shall be available to the former president. Presumably, that means the National Archives has to give him copies of records whose access isn't otherwise restricted.

As for classification, although that argument is bullshit, it doesn't even matter. In some instances, the property receipt identified records that included the most sensitive information that the government keeps. That shit is radioactive, and it can't just be carted off to a completely unsecure location like Mar-a-Lago.

It's way past time for Trumpers to face up to the long-known truth that their idol is a fraud, a crook, and a danger to national security.

44 U.S. Code Chapter 22 - PRESIDENTIAL RECORDS
The United States shall reserve and retain complete ownership, possession, and control of Presidential records; and such records shall be administered in accordance with the provisions of this chapter.
The Presidential records of a former President SHALL BE AVAILABLE to such former President or the former President's designated representative.
