Nope,you can be hauled in for suspicion or questioning without being charged... so basically if a cop wants to be an asshole can take you to jail hold you there for a while, and then has to charge you or let you go.

Oh, they can do it, but not legally. If they do it illegally they risk a nice lawsuit.

Incorrect. They need probably cause to hold you even if it's not charging you with a crime. Even a stupid public defender could get you kicked if they don't have a reasonable cause to hold you.

El Wrong O... Police come up with a host of reasons to haul your ass in and not charge you.  They can haul you in for a 5150 crazy, this is a judgment call by the officer and put you in a cell for observation up to 72 hours, nothing you can do about it.

The Trump  appointed supreme court (and many of the other federal justices) have lived their entire lives in social and economic bubbles. Therefore, extra legal protection is needed to avoid the shock of what discrimination looks like to a person of color.  Even the female appointee grew up in a cultish bubble where gender discrimination is not just the norm but a virtue.
