Bankruptcy itself is not a crime, but if fraud was committed to inflate the vaue to obtain the loans or to inflate the value to attract capital from LP's to invest in a project.

Okay, for those with short memories, lol. We have discussed this case before. Now we are talking primarily about the penalties.

Fraud against who? Where or who is the victim?
An easy to understand example by David Cay Johnson:

You work at an employer that closes up Friday night and opens up on Monday morning. At the end of the day Friday, you take $100 out of the till. You go to the casinos and win a $1,000.  Before the business opens up again you put a $100 back in the till.

You have committed a crime of thievery. Secondarily, the money that you won at the casino is ill gotten gains. The law is clear. You are not entitled to any money you got through a criminal act. Since Donald Trump's behavior has been shown to be fraud, a criminal act, then all of the profit he has made from this fraud is ill gotten gains and could be confiscated.
The legal word to explain most of the 355 million dollar fine is Disgorgement

One of the more damnable things about Donald Trump is his vicious attack on the American judicial/legal system. He knows full well that Joe Biden's administration has absolutely nothing to do with the State of New York prosecuting him for fraud. Trump snivels about the court clerk is against him, the judge is against him, the judge's wife is against him. He knows better than this, he is just preaching to his cult followers AND to those people that don't have the time or inclination to follow these cases in detail.

Whenever he loses in anything, be it elections, court cases, or golf matches, he attacks the system or its personnel as corrupt. When he loses, it's ALWAYS a hoax.

Most legal experts are saying the fine will be significantly reduced on appeal if not overturned entirely.

The article you linked to didn't say anything remotely close to what you claim is being said by "most legal experts."

Donald Trump has been ordered to pay over $450 million in fines and interest for misrepresenting the value of his properties. MSNBC Legal Analyst Charles Coleman reveals how the New York judge made his decision "appeal-proof."

Justice Engoron barred Mr. Trump for three years from serving in top roles at any New York company, including portions of his own Trump Organization. He also imposed a two-year ban on the former president's adult sons and ordered that they pay more than $4 million each. One of them, Eric Trump, is the company's de facto chief executive, and the ruling throws into doubt whether any member of the family can run the business in the near term.

The judge also ordered that they pay substantial interest, pushing the penalty for the former president to $450 million, according to the attorney general, Letitia James.

Mr. Trump will appeal the financial penalty but will have to either come up with the money or secure a bond within 30 days. The ruling will not render him bankrupt, because most of his wealth is in real estate, which altogether is worth far more than the penalty.
